Indian Police Service (IPS) officer A. Arun has filed a defamation suit against YouTuber ‘Savukku’ Shankar alias A. Shankar, seeking damages of over ₹1 crore, along with interest at the rate of 12% per annum from the date of the filing of the suit till the date of realisation of the amount.
In his plaint, the officer said, he was entitled to damages towards loss of reputation, emotional distress, mental agony, professional harm, and violation of his dignity and privacy due to a series of YouTube videos posted by the defendant, levelling various allegations against him.
The plaintiff also sought a permanent injunction restraining not only the YouTuber but also his agents, representatives, followers, and any other person acting on their behalf from publishing, republishing, broadcasting, uploading, circulating, sharing, or posting defamatory content against him.
He also urged the court to restrain all those individuals from disseminating any insinuations or imputations referring to him either by name, photograph, designation, initials, pseudonym, code name, description, or any other indirect identification in the print, digital, audio-visual, or electronic media.
Mr. Arun also prayed for a direction to YouTube and X Corp to take down/delete/remove all the posts, tweets, and videos that had been listed out by him as being defamatory and urged the court to direct the YouTuber to pay the costs incurred for the filing of the present suit for damages.
Until the disposal of the suit, he also pleaded for an interim injunction restraining Mr. Shankar, his agents, representatives, followers, and any other person acting on their behalf from publishing and circulating defamatory allegations, insinuations, and imputations against him.
He insisted that YouTube as well as X Corp should also be directed to take down the defamatory posts, videos, and tweets until the disposal of the suit, since their continued existence in the public domain was causing harm to his reputation and several years of unblemished service.
The plaintiff asserted there was no iota of truth in the corruption and other allegations levelled against him by the YouTuber and yet, there had been a continuous vilification of him on social media.
