Pangilinan seeks Senate probe into PH’s ‘Ayungin Deal’ with China

MANILA, Philippines — Sen. Francis “Kiko” Pangilinan sought a Senate investigation into the so-called “Ayungin Deal” or “Provisional Understanding” that the Philippines entered into with China covering rotation and resupply missions to the grounded BRP Sierra Madre.

In the proposed Senate Resolution No. 536, filed on Monday, Pangilinan wants the Senate to determine whether the arrangement is consistent with the 2016 arbitral award and examine its implications on the Philippines’ sovereign rights in the West Philippine Sea.

The senator noted that the ruling placed Ayungin (Second Thomas) Shoal within the Philippines’ exclusive economic zone (EEZ) and continental shelf.

Pangilinan also raised questions over the deal’s legal basis, scope and implications, and sought to determine whether adequate institutional safeguards are in place to ensure accountability in future arrangements affecting the country’s maritime rights.

Retired Supreme Court Senior Associate Justice Antonio Carpio has called for the cancellation of the deal, arguing that the arbitral ruling already established Ayungin Shoal as part of the Philippines’ EEZ.

His call came after two Philippine Navy personnel were wounded in a confrontation with the China Coast Guard at the BRP Sierra Madre.

Chinese Ambassador Jing Quan, meanwhile, said activities at the Sierra Madre went against the spirit of the provisional agreement.

Meanwhile, the Department of Foreign Affairs on Tuesday in a message sent to reporters on Tuesday said it respects the Senate’s mandate to conduct hearings and “welcomes the opportunity to clarify matters surrounding the Provisional Understanding at the proper forum and in coordination with defense and security agencies.” /mr
