Husband, alleged partner caught inside Cebu City hotel

CEBU CITY, Philippines — A 32-year-old married man and his alleged 29-year-old partner remain under police custody after they were caught and arrested in a hotel in Cebu City and are set to face complaints for alleged violation of the Anti-Violence Against Women and Their Children (VAWC) Act, as well as concubinage.

The husband and his partner were arrested at around 4:45 a.m. on Thursday, July 30, in a hotel in Barangay Guadalupe by personnel of Guadalupe Police Station of the Cebu City Police Office (CCPO).

Police said the man is facing a complaint for the alleged violation of Republic Act No. 9262, or the Anti-Violence Against Women and Their Children Act of 2004, as well as concubinage under the Revised Penal Code.

As of Friday, July 31, both remained detained while police prepared the necessary documents for the filing of the appropriate complaints before the Cebu City Prosecutor’s Office.

Wife sought police assistance

According to the police report, the case stemmed from a complaint filed by the man’s 31-year-old wife, a resident of Sitio Qyda III, Barangay Quiot, Cebu City.

Police said the wife went to the said police station at around 3 a.m. on July 30 to report that her husband, who also lives in Sitio Qyda III, Barangay Quiot, was allegedly having an affair with another woman.

She also informed responding officers that she had tracked the two to a hotel in Barangay Guadalupe and requested police assistance to pursue the appropriate legal complaints.

Acting on the report, police proceeded to the hotel, where they arrested the two suspects.

Police said the man is facing a complaint for the alleged violation of Republic Act No. 9262 as well as concubinage under the Revised Penal Code.

Police also arrested the 29-year-old woman, a resident of Barangay Calamba, Cebu City, in connection with the concubinage complaint, according to the report.

Authorities said both suspects were informed of the nature of the complaints against them and were apprised of their constitutional rights in a language they understood before being taken into custody.

As of Friday, police had yet to provide an update on whether the woman would also face a complaint carrying the penalty of “destierro” or banishment.
